Membership Terms of Service

Please read carefully. By purchasing this product, the following Terms and Conditions are entered into by Performing in Education, LLC (“Company”, “we”, or “us”) and You (“Client”, “Member”, or “You”) agree to the following terms stated herein.

Performing in Education, LLC (herein referred to as “Performing in Education, LLC” or “Company”) agrees to provide Program, “Simplify Writing” (herein referred to as “Program”) identified in the online commerce shopping cart. As a condition of participating in the Program, you agree to be bound by and to abide by all policies and procedures set out in this Agreement, including those incorporated by reference.

Membership Content

Content is in the form of digital downloads, such as PDFs, PowerPoints, and Google files. No printed material will be sent to you. Any printed material shown in images or video is for example purposes only. You are responsible for printing any paper resources you download from this program.

New membership content is provided to you by Performing in Education, LLC through the password protected membership area throughout the year. During any given month, you will have access to the current month, the following month, and the prior month (if applicable). For example, in February, you will have access to January, February, and March lesson plans. On March 1st, you will lose access to January’s lesson plans. You will also have full access to all of the writing tools and training. A monthly email will be sent to the email address listed on your account to notify you when content has been changed. Make sure to download any resources you intend to use if it will be expiring soon.

Formal lesson plans will be provided to you from August-May. These lessons may be moved around to match your school schedule (including September start dates). Additional content will be provided for those who are in school during months that do not have coverage. Some examples of this content are: journal prompts, bonus lessons (like poetry), and grammar resources. These will be available for you throughout the year to fill any gaps or use for other purposes. All lesson plans are given weekly, so you can easily move lessons on your calendar around your individual school breaks and start/end dates.

Material Usage

All content included as part of the Program, such as text, graphics, logos, images, as well as the compilation thereof, is the property of the Company or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights.

A membership license grants you access to copyrighted content on the Simplify Writing website for personal classroom use. Each teacher using the resources must have a valid membership license in order to use the copyrighted content in the Simplify Writing Membership. Each membership license is for one classroom teacher only. It is a violation of the TOS to share one membership or to distribute the copyrighted materials from this membership to non-members. Your membership must stay current in order to use these materials.

Membership Renewal

Monthly and annual memberships renew automatically using your card on file. You can make changes to your membership payment under the My Account link, located in the menu on the top right of your screen. Click your name and/or profile picture to access this menu. You may also contact us.

Cancellation & Refund Policy

Performing in Education, LLC offers a grace period the first 7 days after initial purchase of the Simplify Writing program. This means that if you purchase a membership and do not find that it’s a good fit, you can contact us for a full refund within 7 days from your initial registration. Canceling your membership from your dashboard will not trigger a refund, it will only prevent the next month from being charged. If you have downloaded more than 30% of the membership content within that 7 days, a refund may be refused. You may only request one refund. For example, if you purchase a monthly membership in August and request a refund during the 7 day grace period, you may not purchase a membership again in December and request a refund during the grace period.

You may cancel your membership at any time under the My Account link, located in the menu on the top right of your screen. Click your name and/or profile picture to access this menu. A partial refund will not be processed if you cancel in the middle of your plan period.

If you decide to cancel your membership, you will lose any discounted pricing. If you decide to sign up for the membership again, you may not have access to the same pricing.  You will lose access to all of the materials and the rights to use them upon cancellation.

Help Desk

Help desk requests will be handled during business hours, Monday-Friday from 9am-3pm MST. We do not work weekends or holidays. Please allow up to 72 hours for a response to your request.


Occasionally, the Simplify Writing membership website may experience a brief outage. If you encounter an issue, please try again later. No promises of perfect service are made.

Refusal of Service

Performing in Education, LLC  reserves the right to refuse or discontinue service to any user for noncompliance with these Terms and Conditions. You agree to indemnify, defend, and hold Performing in Education, LLC harmless from any claims and expenses, including reasonable attorneys’ fees, arising from or related to any breach by you of any terms of this agreement.


Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

No advice or information, whether oral or written, obtained by you from Simplify Writing or through, or from, the service shall create any warranty not expressly stated in the TOS.


The laws of the State of Arizona will govern this Agreement. The laws of the State of Arizona will govern any dispute arising from the terms of this agreement or breach of this agreement and you agree to personal jurisdiction by the state and federal courts sitting in Arizona. The parties hereby expressly waive trial by jury in any action, proceeding or counterclaim brought by either of the parties against the other on any matters whatsoever arising out of, or in any way connected with, these Terms and Conditions and agree to submit to binding arbitration.
